Inadmissibility

The Immigration and Refugee Protection Act (“IRPA”) describes different grounds of inadmissibility, which include: (a) security grounds, (b) human or international rights violations, (c) criminality, (d) organized criminality, (e) health grounds, (f) financial reasons, (g) misrepresentations, (h) non-compliance with Canadian immigration laws, and (i) inadmissible family members. Each of these grounds of inadmissibility are described in greater detail below.

Foreign nationals are subject to all of these grounds of inadmissibility; permanent residents are subject to some, but not all of these grounds of inadmissibility.

A permanent resident or a foreign national is inadmissible on the following security grounds:

  • Engaging in an act of espionage or an act of subversion against a democratic government, institution or process as they are understood in Canada;
  • Engaging in or instigating the subversion by force of any government;
  • Engaging in terrorism;
  • Being a danger to the security of Canada;
  • Engaging in acts of violence that would or might endanger the lives or safety of persons in Canada; or
  • Being a member of an organization that there are reasonable grounds to believe engages, has engaged or will engage in acts referred to in paragraph (a), (b) or (c).

Irrecevabilité

La Loi sur l’immigration et la protection des réfugiés (LIPR) décrit différents motifs d’irrecevabilité, notamment: a) des motifs de sécurité, b) des violations des droits de l’homme ou des droits internationaux, ) des raisons de santé, (f) des raisons financières, (g) des fausses déclarations, (h) le non-respect des lois canadiennes en matière d’immigration et (i) des membres de la famille non admissibles. Chacun de ces motifs d’irrecevabilité est décrit plus en détail ci-dessous.

Les ressortissants étrangers sont soumis à tous ces motifs d’irrecevabilité; les résidents permanents sont soumis à certains, mais pas tous ces motifs d’interdiction de territoire.

Un résident permanent ou un étranger est interdit de territoire pour les raisons de sécurité suivantes:

  • Se livrer à un acte d’espionnage ou à un acte de subversion contre un gouvernement, une institution ou un processus démocratique, au sens où on l’entend au Canada;
  • Engager ou inciter à la subversion par la force de tout gouvernement;
  • S’engager dans le terrorisme; 
  • menacer la sécurité du Canada ;
  • Se livrer à des actes de violence qui pourraient ou pourraient mettre en danger la vie ou la sécurité des personnes au Canada;
  • ouêtre un membre d’une organisation qui, selon des motifs raisonnables de croire, commet, a commis ou commettra les actes visés aux alinéas a), b) ou c).

Terminologies associées à noter:
Inadmissibilité criminelle, demande de réadaptation pénale (criminalité non grave, criminalité grave); Condamnations pour voies de fait; Réadaptation réputée (en raison du passage du temps); Entrer au Canada avec une condamnation pour conduite avec facultés affaiblies ou sous l’influence.
